Aiexpress – The trial for the suspects accused of killing a 5-year-old in a 2023 shooting on I-880 in Fremont is set to begin this month.
“I just want justice because that’s what my daughter deserves,” Sophia Crisostomo adds.
Crisostomo is battling for her daughter Eliyanah, who was fatally shot in April 2023 while driving along I-880 near the Fremont-Milpitas border in Alameda County.
“There was no road rage there, nothing was involved,” Crisostomo added. “They murdered my daughter on my father and mother-in-law’s birthdays. We were going to dinner that day; there was no road rage.”
Three gang members have been charged with murder in the deadly shooting of 5-year-old Eliyanah on Interstate 880 in Milpitas, according to the district attorney’s office.
The preliminary hearing in this matter is scheduled for next week. Pamela Price, former Alameda County District Attorney, released a video statement concerning this case last summer.
“Those three men have each been charged with murder with gang and gun enhancements,” Price stated at the time.
However, they were not charged with murder under extraordinary circumstances, thus if convicted, they will not be eligible for parole after sentencing. Crisostomo is requesting to see it, and legal commentator Steven Clark believes it is possible in this case because it was a drive-by gunshot.
“Am I correct in saying that without the special circumstances, there would be a possibility for parole?” asked ABC 7 News reporter J.R. Stone.
“Absolutely, what the special circumstances allegation does, it ensures that someone never walks the streets again,” Clark said CNN.
Crisostomo’s kid was seated behind her late daughter when she was shot and killed. She claims her kid is now in therapy but is still struggling after witnessing what happened to his sister.
“I remember hearing her say she wants chocolate cake. “That was the last thing she said, and then they took her for no reason,” Crisostomo explained.
ABC7’s calls and emails to the Alameda DA’s office, which is currently managed by an interim DA, were not returned Tuesday night. Clark said the public will pay great attention to this case and others like it following DA Price’s recent recall.
“The voters spoke very clearly in Alameda County that they did not want Pamela Price or her charging philosophy to be in charge of the DA’s office any longer,” Clark told me. “And, how aggressively will these instances be prosecuted? This is especially true when a little child is murdered indiscriminately.
