Florida DMV Revokes Trans TikToker's Driver's License Amid Gender Label Law Violation Concerns

Aiexpress – The Florida Highway Safety and Motor Vehicles (FLHSMV) told a transgender TikToker to change their gender on their driver’s license, so they did.

As “Jamesissmiling” on TikTok, trans actor James Rose shared a video on Dec. 20 that you can’t see anymore in which he says there is a hole in Florida law that lets people change their gender identity on IDs.

“I just got my gender changed on my driver’s license in the free f—ing state of Florida,” Rose said. “Oh my god, Ron DeSantis would be yelling right now if he knew this!” There is now a woman’s name on this little card.

On Tuesday, the Libs of TikTok X account shared the news that FLHSMV knew about the video and took away Rose’s new license on Monday.

Fox News Digital got an answer letter from Deputy Executive Director Robert Kynoch that confirmed Rose’s license was taken away because it seemed to be in violation of the state’s DMV policy.

“Please be aware that the sex identifier on the replacement Florida driver’s license you were given on December 20, 2024, was changed from male to female without your permission.” “Therefore, that license is no longer valid and has been revoked,” the letter said.

The letter also said that the department is now looking into the matter because they think James may have broken the law by “knowingly to make a false statement, knowingly conceal a material fact, or otherwise commit a fraud.” They think this because James used air quotes around the word “lost.”

The boss said, “There are two separate issues.” “The first thing you need to do is renew your license and get a sex change.” In Florida, that is against the law. It wasn’t right for the DMV to handle this. The second question is whether or not this person really lost their license. Because it’s against the law for them to say they did something when they didn’t.

In the letter, it was also said that the Department would remind County Tax Collectors of Florida’s rules on the subject and do an audit “to see if similar mistakes have been made before.”

Dave Kerner, Executive Director of the FLHSMV, told Fox News Digital that the reminder is expected to be sent out on Wednesday.

“We maintain quality assurance in our program to ensure it won’t happen again,” he said.

Griffin made a comment on his X account as well.

Jeremy Redfern, who is the press secretary for DeSantis, also said something about the news on his X account.

Fox News Digital tried to get Rose and Creative Artists Agency to say something.

In a memo sent to county tax collectors last year, FLHSMV explained its new stance on gender on driver’s licenses.

“Under s. 322.17 F.S., the Department can issue a replacement license only when a license or permit is lost or stolen, or when there is a subsequent change in the licensee’s name, address, or restrictions,” Kynoch wrote then. “Furthermore, the term ‘gender’ in s. 322.08, F.S., does not refer to a person’s internal sense of his or her gender role or identification, but has historically and commonly been understood as a synonym for ‘sex,’ which is determined by innate and immutable biological and genetic characteristics.”
