10-year-old Boy Cannot Face Charges For Alleged Homicide He Claims Occurred 2 Years Ago

A 10-year-old boy from South Texas, who is currently being questioned for allegedly threatening to kill a classmate, shocked investigators when he revealed that he had killed a man two years ago for no apparent reason. This information was disclosed by law enforcement officials. However, despite this revelation, the boy cannot be charged for the crime under state law.

According to a news release from the Gonzales County Sheriff’s Office, a student in the Nixon-Smiley Consolidated Independent School District recently confessed to school officials that he had shot and killed a man in 2022. This admission came as he was being questioned regarding an alleged threat he made to another student on a bus last week.

During the investigation, the child informed the authorities that he had no prior acquaintance with Rasberry and had observed him strolling near the RV earlier that day.

Investigators discovered the gun used in Rasberry’s murder at a pawn shop in a neighboring town on April 12. They were able to confirm that the shell casings found at the crime scene matched the gun. However, due to the child’s age being under 10 at the time of the crime, the release stated that he cannot be charged in connection to the 2022 homicide, referring to the Texas Penal Code.

Jonathan Fojtik, the brother of the homicide victim, expressed his shock and sorrow upon learning that the perpetrator of the senseless murder was only 7 years old. He described it as a tragic event that is difficult to comprehend. Fojtik also shared that his brother, Brandon, was a caring individual who would go out of his way to help others.
