Donald Trump Requests That NY Criminal Trial Be Postponed

Former President Donald Trump’s legal team is requesting a postponement of his trial in the criminal case initiated by Manhattan District Attorney Alvin Bragg. They aim to wait until the Supreme Court makes a ruling on whether he has immunity from criminal prosecution for his actions during his presidency.

In a motion filed by President Donald J. Trump’s attorneys on Monday, he respectfully requests an adjournment of the trial. This is to allow for a review of the scope of the presidential immunity doctrine in Trump v. United States, which the Supreme Court has agreed to hear on February 28, 2024. The case is scheduled to be argued before the Court on April 25, 2024. Additionally, the motion aims to preclude evidence of President Trump’s official acts at trial based on presidential immunity.

Former President Donald Trump is facing charges of falsification of business records by Bragg. The charges stem from reimbursements he made to his former lawyer, Michael Cohen, who had previously paid off Trump’s mistress, Stormy Daniels.

Adam Klasfeld, a legal reporter, went into more detail about the Trump team’s argument on X.

According to Klasfeld, all 34 charges are connected to Trump’s reimbursements to Michael Cohen, which took place primarily during his presidency. These reimbursements were allegedly concealed through the use of falsified invoices, ledger entries, and checks. The filing appears to challenge the admissibility of evidence from this period in relation to Trump.

“All 34 charges relate to Trump’s reimbursements to Michael Cohen, which occurred mostly during his presidency—and were allegedly covered up with falsified invoices, ledger entries and checks,” wrote Klasfeld. “This filing seems to challenge what evidence from this time can be used against Trump.”
