Former Marine Sentenced to Prison for Attacking Officers with ‘TRUMP 2020’ Flag on Hockey Stick on Jan. 6th

A Marine Corps veteran from Michigan who attacked officers at the U.S. Capitol on January 6th with a hockey stick bearing a “TRUMP 2020” flag has received his sentence this week.

Michael Joseph Foy, aged 32, has been handed a 40-month prison sentence, followed by 24 months of supervised release, by U.S. District Judge Tanya S. Chutkan. Foy was found guilty of two felonies on June 22: obstruction of an official proceeding and assaulting, resisting, or impeding certain officers.

Foy expressed his apologies to the officers and “to my country” while extending his gratitude to the judge for granting his release from pretrial custody in 2021. This decision enabled him to secure a job, as reported by The Associated Press.

According to the AP, he expressed his gratitude, stating, “You enabled me to create the fulfilling life I desperately sought after leaving the Marine Corps.”

Judge Chutkan, an appointee of Barack Obama who presides over the election interference case involving former President Donald Trump, handed down a shorter sentence to Foy than what the prosecution had suggested. Despite acknowledging his positive transformation, she expressed her concern over the violent nature of his actions.

According to the AP, she expressed her disapproval by stating, “You took an oath to serve your country, and you knew better. What you did there on January 6th was not serving your country.”

Foy’s defense attorney did not promptly respond to a request for comment from Law&Crime. The defense attorneys representing Foy did not seek any prison time.

Foy made the journey from Michigan to Washington in order to attend Trump’s “Stop the Steal” rally. His intention was to protest against the results of the 2020 presidential election and encourage members of Congress to object to or postpone the official certification of electoral votes, according to authorities.

With a TRUMP 2020 flag fastened to a hockey stick, he joined a sizable crowd as they made their way towards the Capitol building at 2 p.m. The group proceeded to topple metal bike rack barricades and disregarded the “AREA CLOSED” signs, eventually reaching the scaffolding of the Inaugural stage. Undeterred, they then proceeded to climb up to the Lower West Terrace.

On January 21, 2021, the FBI apprehended Foy in Michigan following a lead provided to agents through the agency’s official Twitter account. The tip included a photograph of a man holding a hockey stick.

The FBI came across a video on January 16, 2021, that showed a man swinging a hockey stick aggressively at someone who was lying on the ground. The video was featured in a New York Times article, and the FBI was able to identify the man as Foy by checking his father’s Facebook page.

Foy served in the Marines from 2015 to 2020 and was honorably discharged. During his time in the military, he held the position of a supervisor on a base in North Carolina. Foy’s expertise as a heavy equipment mechanic was valued both within the United States and overseas.
